Environmental Laws and Agencies

Pollution control needs more than good intentions, because the cost of polluting falls on society while the saving goes to the polluter. India therefore has a set of laws that make standards binding, and agencies whose job is to measure, enforce and prosecute.

The Main Laws

  • The Water Act of 1974 was the first major pollution law and created the pollution control boards.
  • The Air Act of 1981 extended the same structure to air pollution and gave the boards power over industrial emissions.
  • The Environment Protection Act of 1986 is the umbrella law covering air, water, land and all living things.
  • It was enacted after the Bhopal gas tragedy made clear how weak the earlier framework was.
  • The Forest Conservation Act of 1980 restricts diversion of forest land and the Wildlife Protection Act of 1972 protects species and habitats.
  • The Biological Diversity Act of 2002 regulates access to biological resources and traditional knowledge.
  • Rules on plastic waste, e waste, hazardous waste and biomedical waste operate under the 1986 umbrella act.

Agencies and Procedures

  • The central pollution control board sets standards and coordinates, while state boards grant consent, inspect and enforce locally.
  • Environmental impact assessment requires that a large project be evaluated for its likely effects before it is approved.
  • The assessment includes a public hearing, so people who will be affected can record their objections.
  • The national green tribunal is a specialised body for the speedy disposal of environmental cases.
  • The polluter pays principle places the cost of pollution on whoever causes it.
  • The precautionary principle says that lack of complete scientific certainty is not a reason to postpone action against a serious threat.
  • Enforcement depends on monitoring capacity, so real time measurement and public disclosure of data matter as much as the law itself.
