Fundamental Rights and Duties

Fundamental Rights are contained in Part III, Articles 12 to 35, and there are six of them today. The right to property was removed by the 44th Amendment in 1978 and is now an ordinary legal right under Article 300A, which is the single most asked point in this topic.

Dr Ambedkar called Article 32 the heart and soul of the Constitution, because without it the other rights could not be enforced. Article 21A, added by the 86th Amendment in 2002, made education a fundamental right for children aged six to fourteen.

The five writs

  • Habeas corpus: produce the detained person before the court.
  • Mandamus: command a public authority to do its duty.
  • Prohibition: stop a lower court from exceeding its jurisdiction.
  • Certiorari: transfer a case or quash an order of a lower court.
  • Quo warranto: question a person's right to hold a public office.

Directive Principles and Fundamental Duties

Directive Principles are in Part IV, Articles 36 to 51, are borrowed from Ireland, and are not enforceable in court. Fundamental Duties are in Part IVA, Article 51A, added by the 42nd Amendment in 1976 on the Swaran Singh Committee's recommendation. They were originally ten and an eleventh was added in 2002.

How many Fundamental Rights are there?

Why is Article 32 called the heart and soul of the Constitution?

Because it allows a citizen to move the Supreme Court directly for the enforcement of Fundamental Rights. Dr Ambedkar used this phrase during the Constituent Assembly debates.

Are Directive Principles enforceable in court?

Directive Principles और Fundamental Duties
