Independence of the Judiciary
Judicial independence means that judges can decide cases according to law and conscience, free from pressure by the executive, the legislature or private interests. It does not mean freedom from accountability or from the Constitution.
Constitutional safeguards
- Security of tenure - a judge can be removed only on the ground of proved misbehaviour or incapacity, through the difficult special majority procedure in both Houses.
- Fixed service conditions - salaries, allowances and privileges are determined by Parliament and cannot be varied to a judge's disadvantage after appointment, except during a financial emergency.
- Charged expenditure - salaries and administrative expenses are charged on the Consolidated Fund, so they are not subject to an annual vote of Parliament.
- No discussion in the legislature - the conduct of a judge in the discharge of duties cannot be discussed in Parliament or a state legislature, except on a motion for removal.
- Power to punish for contempt - Articles 129 and 215 make the Supreme Court and High Courts courts of record with power to punish contempt.
- Bar on practice after retirement - a retired Supreme Court judge cannot plead before any court or authority within India.
- Separation from the executive - Article 50 directs the state to separate the judiciary from the executive in the public services.
- Power of appointment of staff rests with the judiciary itself, and its jurisdiction cannot be curtailed by ordinary legislation.
Judicial accountability

- The difficulty of removal is deliberate - it protects independence, but it also means no judge has yet been removed by the constitutional process, which fuels the accountability debate.
- Transparency in appointments is the other half of the debate, since the collegium works without a statutory framework.
Why independence matters
- The judiciary is the guardian of Fundamental Rights; a court dependent on the executive cannot restrain it.
- It is the interpreter and guardian of the Constitution, and the final arbiter in disputes between the centre and the states, which requires neutrality between them.
- It enforces the rule of law, under which government action must have legal authority.
- The framers chose independence deliberately, drawing on the American model, while keeping the parliamentary system from Britain - which is why India combines parliamentary supremacy in law making with judicial supremacy in constitutional interpretation, a balance held together by the basic structure doctrine.

Factual questions ask which fund judges' salaries are charged on and which articles make the courts courts of record. Statement-based questions test whether a judge's conduct can be discussed in Parliament. Application questions ask which safeguard protects against a particular kind of pressure.
UPSC / State PSC ke liye
The sharpest formulation for an essay is that independence and accountability are not opposites but preconditions of each other - an unaccountable judiciary loses public confidence, and a judiciary dependent on the executive cannot protect rights. Present the appointments debate as the current test of whether that balance is being held.
